1. Agreement to Terms

By accessing or using Mctaba Academy at academy.mctaba.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. Mctaba Academy is operated by Mctaba Labs.

2. Accounts

You must create an account to access course content. When creating an account, you agree to:

  • Provide accurate and complete information.
  • Maintain the security of your password.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

3. Course Access and Licensing

When you purchase a course on Mctaba Academy, you receive:

  • A personal, non-transferable, non-exclusive license to access the course content.
  • Access to the course for 12 months from the date of purchase, including any content updates during that period.
  • The right to use the knowledge and skills gained for personal and commercial projects.

After your 12-month access period expires, you may purchase access again or subscribe to the All-Access plan for continued access.

You may not:

  • Share your account credentials with others.
  • Redistribute, resell, or republish course content (videos, text, code examples, or assignments).
  • Record, download, or scrape course materials for redistribution.
  • Use course content to create a competing educational product.

4. Payments and Pricing

Individual Course Purchases

  • All prices are listed in Kenyan Shillings (KES) and are inclusive of applicable taxes.
  • Payments are processed securely through Paystack. We accept M-Pesa and international cards (Visa, Mastercard).
  • Course access is granted immediately upon successful payment and lasts for 12 months.
  • We reserve the right to change prices at any time. Price changes do not affect existing purchases.

All-Access Subscription

  • The All-Access subscription costs KES 2,999 per month and grants access to all courses on the platform.
  • Your subscription renews automatically each month. Card subscriptions are charged automatically by Paystack. M-Pesa subscriptions are renewed via an STK push prompt to your phone.
  • If a renewal payment fails, we will retry for up to 3 days. Your access continues during this grace period.
  • After 3 failed payment attempts, your subscription is paused and course access is suspended until payment is resolved.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
  • No partial-month refunds are issued upon cancellation.

5. Refund Policy

All individual course purchases are final. We do not offer refunds on purchased courses. Every course provides free preview lessons so you can evaluate the content before purchasing. Subscription cancellation is not a refund — you retain access until the end of your paid billing period. For full details, see our Refund Policy.

6. Intellectual Property

All content on Mctaba Academy, including but not limited to text, code examples, graphics, logos, course materials, and the platform software, is the intellectual property of Mctaba Labs and is protected by copyright law. You may not reproduce, distribute, or create derivative works from our content without written permission.

7. User Conduct

You agree not to:

  • Use the platform for any unlawful purpose.
  • Attempt to gain unauthorized access to other accounts or platform systems.
  • Interfere with or disrupt the platform or its infrastructure.
  • Upload malicious code, spam, or harmful content.
  • Harass, threaten, or abuse other users or staff.

8. Disclaimers

Mctaba Academy provides educational content on an "as is" basis. We do not guarantee specific employment outcomes, salary levels, or career results from completing our courses. Success depends on your effort, dedication, and market conditions. While we strive to keep our content accurate and up-to-date, technology evolves rapidly and some information may become outdated.

9. Limitation of Liability

To the maximum extent permitted by law, Mctaba Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our platform or courses.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or a prominent notice on the platform.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
